Overview
The seesawing in the case of the South African asbestos mining claimants continued over several years. Then, in a July 2000 landmark decision, the British House of Lords Court of Appeals ruled that Cape plc could be sued in the British courts. A settlement was reached, but when Cape plc reneged on the first payment, claiming financial distress, the claimants' lawyers added the South African mining company Gencor, a spinoff of Cape, to the lawsuit. The case details Gencor's role in South African asbestos mining and its legal wrangling with the asbestos victims and their attorneys. This case is part of a series labeled A through D, UVA-E-0285 through UVA-E-0288.
